H-1B grace periods: what actually happens after day 60

If your H-1B employment ends, you get a discretionary grace period of up to 60 days to find a new sponsor, change status, or leave the country. Almost everyone knows the number. Far fewer know what the number actually measures, and that gap is where people get into trouble.

The clock starts earlier than you think

The 60 days run from your last day of employment, not from the day you were told, not from your last paycheck, and not from the day your employer files the withdrawal. If you were notified on the 1st and your last working day was the 15th, your clock starts on the 15th.

It is also capped by your I-94. If your I-94 expires 30 days from now, you get 30 days, not 60. The grace period never extends your status beyond the date already on your I-94.

What happens the day after it ends

Nothing visible. No letter arrives, nobody knocks. That silence is exactly why this catches people out. What changes is your legal category: you stop being a person in valid status and start accruing unlawful presence.

  • You can no longer change or extend status from inside the US in the ordinary way
  • A new H-1B petition generally cannot be filed as a change of status, it has to be consular processed
  • Unlawful presence accrues daily, and the consequences step up at 180 days and again at one year

Does a few days really get you deported?

Realistically, no. Nobody is removed for being three days late. Removal proceedings are a slow, resource-heavy process and a short overstay is not what triggers them.

But that is the wrong question. The risk is not a knock at the door, it is what a short overstay quietly does to your paperwork for years afterwards. A future consulate interview, a green card filing, or a routine extension can all surface it. Officers have discretion, and a gap in status is a reason to exercise it against you.

Under 180 days of unlawful presence carries no automatic re-entry bar. At 180 days it becomes a 3-year bar. At one year it becomes 10. The jump is steep, and it is counted automatically.

What to do if you are going to miss the date

  1. 1Confirm your exact last day of employment in writing, and count from that date
  2. 2Check your I-94 expiry, because the shorter of the two governs
  3. 3Talk to an immigration attorney at week two, not week eight, since the useful options need lead time
  4. 4Consider a change of status filing (B-2, F-1, or H-4) as a bridge; a timely filing preserves your position while it is pending
  5. 5If you are close to a new offer, ask the employer about premium processing before your window closes

The single biggest mistake we see is waiting. People spend five of their eight weeks hoping an offer lands, then start looking at options with days left. The options that work are the ones you file early.

Is the 60-day grace period guaranteed?

No. It is discretionary, and it is capped by your I-94 end date. Treat it as a maximum, not an entitlement.

Can I use the grace period more than once?

Generally once per authorised validity period. It is not a benefit that resets with every job change.

Can I travel during the grace period?

Leaving is usually treated as ending the period. Re-entry without a valid job and petition is difficult, so speak to an attorney first.

Does a pending change of status stop the clock?

A timely filed, non-frivolous application generally protects you while it is pending. The word doing the work there is timely.

Final thoughts

Sixty days sounds generous until you have lived through one. Interview cycles at large employers routinely run longer than that. Start the search on day one, file your backup on week two, and treat the deadline as the date everything must already be resolved by.
